1. Acceptance of Terms
By registering, accessing, or using any services of SAUVIKA SERVICES, the user (“Franchisee / User / RBDM”) agrees to be bound by these Terms and Conditions. If you do not agree, you must not use the platform.
2. Eligibility & Registration
- User must provide accurate and complete details during registration.
- SAUVIKA reserves the right to approve or reject any application without assigning any reason.
- User is responsible for maintaining confidentiality of login credentials.
3. Nature of Relationship
- The User acts as an independent entity.
- Nothing in these terms shall be deemed to create partnership, employment, or agency.
4. Services & Platform Usage
- SAUVIKA provides access to digital services, financial facilitation, and educational support through its portal.
- Services may be modified, updated, or discontinued at any time without prior notice.
5. User Obligations
The User agrees to:
- Follow all operational guidelines issued by SAUVIKA
- Maintain proper infrastructure and operational setup
- Keep records of transactions and customers
- Comply with all applicable laws (GST, IT laws, financial regulations)
- Maintain confidentiality of all business and customer data
6. Prohibited Activities
The User shall NOT:
- Engage in fraudulent or illegal activities
- Misuse the portal or services
- Use SAUVIKA brand without authorization
- Run competing or similar services during association (if applicable)
- Share login credentials or access with unauthorized persons
7. Financial Terms
- All fees paid (registration, service charges, etc.) are non-refundable unless stated otherwise in writing.
- Commission shall be paid only after actual receipt from third-party service providers.
- SAUVIKA reserves the right to modify pricing, commission, and charges at any time.
8. Security Deposit (If Applicable)
- Security deposit may be required and may be forfeited in case of breach, misconduct, or non-performance.
9. Data Privacy & Security
- User must ensure proper protection of customer data.
- Any data breach, misuse, or cyber incident shall be the sole responsibility of the User.
- Sharing of login credentials is strictly prohibited.
10. Intellectual Property
All trademarks, logos, software, and brand materials remain the exclusive property of SAUVIKA.
Unauthorized use shall result in legal action.
11. Suspension & Termination
SAUVIKA reserves the right to:
- Suspend or terminate access without prior notice in case of:
- Fraud or suspicious activity
- Violation of terms
- Regulatory requirements
- User may request termination by written notice.
12. Effect of Termination
Upon termination, the User must:
- Stop using brand name and services immediately
- Clear all dues
- Return all materials (if applicable)
13. Penalty & Enforcement
SAUVIKA may impose:
- Monetary penalties
- Service suspension
- Permanent termination or blacklisting
14. Liability & Indemnity
- User shall be solely responsible for all actions, transactions, and activities.
- User agrees to indemnify SAUVIKA against any loss, damage, or legal claims.
15. Limitation of Liability
SAUVIKA shall not be liable for:
- Loss of profit
- Business interruption
- Indirect or consequential damages
16. Right to Recover Dues
SAUVIKA reserves the absolute right to:
- Adjust dues from wallet, commission, or deposits
- Initiate legal recovery proceedings
17. Audit & Inspection
SAUVIKA may audit records, inspect operations, and verify transactions at any time.
Non-cooperation will be treated as a breach.
18. Non-Solicitation
User shall not:
- Hire SAUVIKA staff
- Divert customers to competing services
(during association and up to 12 months after termination)
19. Amendments
SAUVIKA reserves the right to modify these Terms at any time. Continued use implies acceptance of updated Terms.
20. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India.
Courts at Patna, Bihar shall have exclusive jurisdiction.
21. Dispute Resolution
Disputes shall first be resolved amicably.
If unresolved, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
22. Force Majeure
SAUVIKA shall not be liable for delays or failure due to events beyond control (natural disasters, government restrictions, etc.).
23. Digital Records & Evidence
All digital records including portal logs, emails, and transactions shall be considered valid legal evidence.
24. No Refund Policy
All payments are strictly non-refundable unless explicitly agreed in writing.
25. Limitation Period
Any claim must be raised within 30 days, failing which it shall be deemed waived.
26. Binding Nature
These Terms shall be binding upon the User, including successors, heirs, and representatives.
27. Acceptance Declaration
By registering or using SAUVIKA services, the User confirms that they have read, understood, and agreed to these Terms and Conditions.
